A class action has been lodged against beleaguered eDiscovery provider Nuix alleging that it made misleading representations or omissions in its initial public offering prospectus and in market disclosures, and that it failed to comply with its continuous disclosure obligations as an ASX listed company.
The action, lodged by Australian ‘no win, no fee’ compensation law firm Shine Lawyers, is on behalf of William Lay and any other shareholders who acquired shares between 18 November and 30 May 2021 inclusive. While other law firms are involved in investigations into Nuix, this is the first confirmed class action. Shine first announced that it was considering a class action in June. In a news release on 22 November confirming the class action, the Brisbane-headquartered firm said that shareholders were bringing the action against Nuix alleging that it gave “inadequate guidance on revenue, misleading sales forecasts, and [that it] breached the company’s continuous disclosure obligations.”
Class actions practice leader, Craig Allsopp said in a statement that the firm’s investigation has revealed that the “company’s prospectus and financial forecasts may have misrepresented or omitted financial information and potential risks, which was misleading and deceptive to investors.”
He added: “This inflated forecast has ultimately cost shareholders hundreds of millions of dollars. Our class action aims to recover these losses for the thousands of investors impacted by Nuix Limited’s alleged misconduct.”
Nuix said on 22 November, in a formal statement acknowledging the class action, that it disputes the allegations and will be defending the claim.

Exterro has hired legal discovery expert and technologist Jenny Hamilton as its new general counsel. Hamilton previously led John Deere’s Global Evidence Team where she helped to build the nearly 200-year-old brand’s e-discovery, investigations and cross-border discovery practice. During her 14 years at Deere, Hamilton executed on a strategically developed blueprint for the global adoption, deployment and use of advanced technology that would transform the Fortune 100 firm company-wide GRC practices. Hamilton and her team selected Exterro as Deere’s first e-Discovery platform.

Relativity’s end-to-end SaaS product RelativityOne is now available in Ireland. The consulting services team at BSI is Relativity’s official launch partner and users can now control their data in-country.

Onna has announced enhancements to its Zoom connector to deliver a more complete and defensible eDiscovery and information governance solution.
Customers can now collect, search, assess, and export data from Zoom Chat alongside Zoom Meetings and other third-party applications, to better support eDiscovery and investigation needs in today’s remote working environment.
Onna’s connectors enable granular, API-based integrations with the most popular collaboration and productivity tools, extracting, then processing and indexing all available data and metadata to create a full, contextualized and searchable repository of an organization’s corporate knowledge.
